11/6/2022 0 Comments Define draconian law![]() The Unlawful Activities (Prevention) Amendment Act, 2019 (UAPA, 2019) was the most recent amendment, and it dealt with widening the definition of “terrorist” to include individuals under Section 35 and 36 of Chapter VI of the Act. #DEFINE DRACONIAN LAW CODE#The 1898 Code of Criminal Procedure (CrPC) was in use at the time and a new CrPC was not introduced until 1973. The UAPA, which was mostly targeting secessionist organisations, was enacted in 1967 against this socio-political setting. Following an ideological schism between China and the Soviet Union, the Communist Party of India (Marxist), considered as a more extreme organisation, split from the CPI in 1964. When Jawaharlal Nehru was the Prime Minister, a constitutional amendment was approved in 1963 on the proposal of the National Integration Council (NIC). After POTA’s withdrawal, most of its provisions were re-incorporated into the UAPA, 1967 through a 2004 amendment. Aside from these two legislations, the Unlawful Activities (Prevention) Act (UAPA), 1967, is one of the earliest anti-terrorism legislation and is still in effect despite multiple changes. The Prevention of Terrorism Act (POTA) was passed in 2002 but was revoked in 2004. It remained in effect for eight years before being repealed in May 1995, after considerable criticism and allegations from a variety of national and international human rights organizations, lawyers, and even ministers and government officials. TADA (Terrorist and Disruptive Activities (Prevention) Act) was passed in 1987. ![]() However, each enactment has been accompanied by its own set of controversies. Many governments have attempted to enact or have enacted legislation that addresses terrorism and other threats to national security. ![]() Its principal goal is to empower authorities to deal with actions that threatened India’s integrity and sovereignty. The Unlawful Activities (Prevention) Act (UAPA) is a statute that grants the government authority to detain individuals for arbitrary and imprecise reasons, in the interest of national security. ![]()
